1. Introduction
Welcome to Diner Q ("Company", "we", "our", "us"). These Terms & Conditions ("Terms") govern your use of our website dinerq.com and our restaurant operating system software, including all features, tools, and services (collectively, the "Service").
By accessing or using the Service, you ("Restaurant", "User", "you") agree to be bound by these Terms. If you do not agree, please do not use the Service.
"Diner Q" means the restaurant operating system platform including Technology OS, Diner Passport, 1HourHotel, and Diner Awards.
"Restaurant" means the business entity that subscribes to Diner Q services.
"Customer" means an end consumer using Diner Passport or ordering via a restaurant's Diner Q system.
"Subscription" means the annual fee paid by Restaurant to access Diner Q services.
"Aggregator" means third-party platforms like Zomato, Swiggy etc.
You must be a legally operating restaurant, cloud kitchen, cafe, or food business in India. By subscribing, you warrant that you have the authority to bind your business.
Diner Q provides:
Technology OS: QR code ordering, kitchen display system, WhatsApp integration, delivery management, multi-language menus, customer database, sales analytics, and payment gateway integration.
Diner Passport: A viral gamified dining membership that restaurants can opt into. Diner Q facilitates the passport program but restaurants set their own offers.
1HourHotel: A marketplace connecting restaurants with hotels. Diner Q only facilitates introductions; contracts are directly between restaurant and hotel. Diner Q takes zero commission.
Diner Awards: A data‑driven recognition program. No entry fee. Winners determined solely by transaction data from Diner Q systems.
0% Commission: Diner Q does not take any percentage of your sales.
Payment Gateway: Restaurants integrate their own Razorpay, Paytm, or Cashfree accounts. Funds go directly from customer to restaurant’s bank account (T+1 settlement).
Gateway Fees: Standard payment gateway fees (~2% + GST) apply and are paid by the restaurant.
Subscription Fee: Annual fee as per chosen plan (Plan A ₹6,999/year, Plan B ₹9,999/year). Fees are non-refundable after 30 days except as provided in the Refund Policy.
Restaurant owns all customer data – names, phone numbers, order history, preferences.
You may export your customer data at any time.
Diner Q does not sell or rent your customer data to any third party.
Diner Q may use anonymised, aggregated data for platform improvement and Awards calculation.
You are responsible for the accuracy of your menu, prices, and offers.
You must comply with all applicable laws (FSSAI, GST, local municipal rules).
You shall not use Diner Q to engage in fraudulent or illegal activities.
You are responsible for training your staff on using the Diner Q system.
Offers displayed in the Passport are set by the restaurant.
Diner Q verifies stamps via 5‑layer system (QR scan, staff verification, random audit, etc.).
Fake stamps or abuse may lead to removal from Passport without refund.
Passport booklet is physical; restaurants must honour valid stamps.
Diner Q only introduces restaurants to hotels. Any commission agreement is between restaurant and hotel.
Diner Q is not a party to delivery or quality disputes.
Written guarantee templates are provided as a courtesy; legal enforceability is the parties’ responsibility.
All Diner Q partner restaurants (with active subscription) are automatically eligible.
Winners are determined by automated algorithms based on real transaction data.
No cash prize; only trophy, digital badge, and media feature (as described).
Diner Q reserves the right to verify data and disqualify fraudulent entries.
All content, logos, software, and trademarks on the Diner Q platform are owned by Diner Q Private Limited. You may not copy, modify, or reverse engineer any part of the Service.
To the maximum extent permitted by law, Diner Q shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the subscription fee paid by you in the preceding 12 months.
You agree to indemnify and hold Diner Q harmless from any claims arising from your breach of these Terms or violation of any law.
Either party may terminate the subscription at the end of the billing cycle.
Diner Q may terminate immediately if you violate these Terms (e.g., fraudulent activity).
Upon termination, you may export your customer data within 30 days.
Diner Q may update these Terms from time to time. Continued use after changes constitutes acceptance.
These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Ahmedabad, Gujarat.
